Duke must submit comprehensive review of Cliffside plant's pollution

Duke Energy plans to appeal a ruling by a judge that has ordered the utility to submit a comprehensive review of emissions from its Cliffside plant. The company is expanding its coal-fired facility west of Charlotte. U.S. District Court Judge Lacy Thornburg gave the company 60 days to come up with the review. Duke Energy CEO Jim Rogers says the company will go ahead with the emissions inventory, but hopes an appeal will lead to a compromise on what's required. "The important thing is that he didn't stop the construction of the project. And I think this is something we can work out and address in a way that satisfies him," he says. Environmental groups praised the judge's decision and say it could serve as a precedent to about a dozen power plants under construction.
